Dear GACE Members,

Good Morning, I need to know if any of your city’s or county’s have an ordnance that makes it mandatory that Tire dealership to charge a disposal feed regardless if the customer wants pay for it or not. We are having a big problem with customer taking the old tires home and throwing them in our alleys or on the side of the roads. If you do could you email it to me a fitzcitymarshall@mchsi.com.

Leon: no state law nor ordinance requires a consumer to pay a fee... the requirement is on the dealer to follow their manifest rules for scrap tire management. When working in Sylvester, I had all my dealers mark the tires people took back with them, and note on their receipts, this gave me an idea of where and who to start with on investigating tire dumps... I will tell you it prevented dumping because people knew they could be tied to a dump.... Illegal dumping is serious fines when you can find the violator...
