What is a good way to start when you have finally won in Court and it is now your responsibility to remove the junk.

Depends on what was awarded in court. If the city or county has permission to clean the area and bids are not required, get a company to clean the area, pay for it and lean the property. If the project is too large you may have to advertise in the paper and take bids.

I agree with Angel, follow what it says in your ordinance for abatements and / or vehicle removal.

First and Foremost: Follow your ordinances and Court Order of Abatement.

Post the order on the property: (placard-paperwork of case-court order)

If it is demolition of a house, your county/city will have a procurement process to follow. The winning contractor will have to follow all permitting requirements.

If it is removing vehicles you will need to ensure the wrecker services are aware that this is a court order removal and you will need to have paperwork filled out on each vehicle.

AND most important: Ensure you have safety measures in place. Police presence... etc. Have buildings cleared before beginning demolition.

There's a plethora of information and process to it all. I just hit the highlights.

I was awarded to remove the nuisance. In my ordinance I can NOT find anything that states I have to have bids. It just states that I cannot exercise anything until I come in from of the BOC.

David,

I suggest speaking with your procurement division to find out if the City/County has a process for hiring a contractor to help abate the nuisance. Your public Works department may be tasked with aiding you in the actual cleanup of the violation outlined in the Order.

I understand you will go before the BOC to notify them of the Court Order to abate the nuisance. You will also need the city/county's legal counsel to help guide you. I am not sure if you have an outlined budget for abatements; that, too, will need approval before you can proceed with abatement actions. Remember just because you have a court order doesn't mean the funds are there to afford the city/county to move forward in abatement and lien processing.

Although procurement may not be in your ordinance, it is most likely a procedure for handling anything that requires contract work for your jurisdiction. The procurement process may depend on the "nuisance" you are abating.

Typically, the life of a Court Order is 270 days after the owner's timeframe has expired (OCGA 41-2-9 (5)) of the Nuisance Abatement Code of Georgia. So you have time to perfect your execution and get a process in place if there isn't one outlined for you to follow.

I am excited for you on this first experience in executing a Court Order of Abatement (nuisance). Good Luck. As you can see we are here to help.
