IPMC 301.3 Vacant structures and land question

Has anyone had experience with an administration trying to quote IPMC 301.3 on undeveloped land? Or does anyone have an opinion on if this section would apply to undeveloped land? If it does not then how would I explain the difference between vacant land and undeveloped land? Thanks in advance for your time.ย

In the context of 301.3 it doesn't specify a distinction between vacant land or undeveloped land.ย  The property owner is required to maintain the property and prevent a nuisance but as the JHA you would make that determination.ย  Your jurisdiction will have to determine how they want to handle undeveloped land and what would be considered a nuisance...overgrown grass and weeds?ย  Tree debris?ย  Where is the undeveloped land located...in a subdivision, developed street, etc.?ย  Typically, undeveloped land isn't regulated as strictly as developed vacant land.ย  Maybe you can do an ordinance amendment to address this issue and make it clear.ย

Thanks for the advise. This particular land is behind a restaurant on a very busy commerce area of the city. To me personally it just looks like a wooded land that was never developed but the city sees it as a blighting problem with weeds in it that needs to be cleared and maintained. I guess if push came to shove I could issue a citation if the owner isn't willing to do anything and let the judge be the determining factor.ย  ย
