Manufactured Homes

I have a zoning question concerning manufactured homes. Perhaps someone can help me with it.ย  Question: I have a person requesting a permit to move in a mobile home. I have checked the address and the zoning does not allow for mobile homes in that location.ย  I told the person that a mobile home was not allowed at the address indicated and got some flack back from them.ย  The person indicated that he was going to ignore the denied permit & move the mobile home in to the address anyway.ย  What would be the next course of action to prevent this person from setting up this mobile home on said property? Any help would be appreciated.

Not sure there is anything that can be done to prevent the person from placing the mobile home. Should the person do it any way theย person should be cited for the zoning violation and let the court l him that you were right and the mobile home will have to be removed.

Once mobile home was pulled onto the property, that is not zoned for mobile homes, I would issue a STOP WORK ORDER. Where the SWO was ignored a citation would be issued for Failure to Comply with a Stop Work Order.ย 

I have found the violation of Failure to Comply allows for the courts to prosecute and give less time for compliance requirements. Many times we are faced with the courts allowing 60 to even 180 days to gain compliance before issuing fines or giving the jurisdictions abatement orders.ย 

Presentation of the facts expand, the education and enforcement aspects of gaining compliance. Fact 1. Knowledge placement of mobile home was not allowed due to zoning requirements. Fact 2. STOP WORK ORDER Issued prior to setup of mobile on in unauthorized zoning district. Fact 3. Responsible Party failed to comply after notice and SWO.ย 

This method allows courts to issue fines for failure to comply and opportunity forย compliance in reasonable time-frames. Also, in the event there is a failure to comply with a Court Order the responsible party will be faced with more stringent fines or possible jail time.
